14. Warranty
To obtain performance of any warranty obligation, the Customer must send an email to the
Company with a detailed description of the issue within a reasonable time after discovery and must
allow the Company reasonable access to the Property to inspect and remedy any covered issues.
All warranties are contingent upon full receipt of payment.
12a. Construction Workmanship Warranty (Five Years).
Keathley Landscaping LLC provides a five (5) year workmanship warranty on all construction work it
performs, including but not limited to stonework, retaining walls, patio covers, outdoor kitchens,
firepits, fencing, hardscapes, drainage installations, and similar improvements. This warranty covers
defects in labor and workmanship. It does not cover damage resulting from the Customer’s misuse,
neglect, or modification of completed work, acts of nature, or extreme weather events.
12b. Low Voltage Landscape Lighting Warranty (Five Years).
The Company provides a five (5) year labor and fixture replacement warranty on all low voltage
outdoor lighting installations. During this five-year period, if a fixture fails due to a defect or
malfunction that is not the result of physical damage or customer misuse, the Company will supply
and install a replacement fixture at no charge to the Customer. The Customer may contact the
Company directly to schedule fixture replacement under this warranty.
Fixtures installed by the Company are FX Luminaire products, which also carry a separate ten (10)
year manufacturer’s warranty on the fixtures themselves. After the Company’s five-year warranty
period expires, the Customer may: (a) contact a licensed FX Luminaire dealer directly to obtain
warranty service or replacement fixtures; or (b) contact the Company to have replacement fixtures
installed at the Company’s standard service call rate.
This warranty does not cover: (a) bulb replacement; (b) wire or fixture damage caused by cuts,
breaks, tears, chewing by animals or pests, lawn equipment, digging, or any other physical damage
regardless of cause; or (c) damage caused by the Customer, third parties, contractors, or acts of
nature. Repairs required due to physical damage to wiring or fixtures will be performed at the
Company’s standard service rates. This warranty is immediately voided on any fixture that becomes
buried, covered, or obstructed by soil, mulch, sod, plant material, hardscape, or any other material
added after installation. It is the Customer’s responsibility to ensure all fixtures remain unobstructed
and properly exposed at all times. The Company is not responsible for damage, malfunction, or
deterioration caused by fixtures being buried or covered, regardless of whether such covering was
done by the Customer, a third party, or natural accumulation.
12c. Sod Installation.The Company does not provide a general warranty on sod installation, as the survival of sod is
dependent on soil conditions, weather, watering practices, and other factors outside the Company’s
control after installation. However, as a courtesy, if individual sod squares fail to establish while the
surrounding lawn is otherwise healthy and thriving, the Company will return to replace those specific
failed squares at no charge to the Customer, provided the Customer notifies the Company within
sixty (60) days of installation and the failure is not attributable to the Customer’s watering or
maintenance practices. This courtesy replacement is not a warranty and does not obligate the
Company to replace entire lawn areas or sod that has failed due to improper watering, drought,
disease, or neglect.
12d. Plant Material Warranty (Three Months – Labor Only).
The Company provides a three (3) month labor-only warranty on plant material installations. If a
plant fails within three (3) months of installation, the Company will install a replacement plant at no
charge for labor. However, the Customer is responsible for purchasing the replacement plant at
current retail cost. This warranty does not cover plant failure caused by the Customer’s watering
practices, pest or disease issues, drought, freeze events, or other conditions outside the Company’s
control. The Company is not responsible for the cost of the replacement plant under any
circumstances.
12e. General Warranty Exclusions.
No warranty provided herein covers: (a) work completed by other contractors before or after the
Company’s installation; (b) irrigation and drainage issues arising from work performed by other
contractors; (c) damage caused by the Customer’s misuse, neglect, or modification of completed
work; or (d) damage caused by acts of nature, extreme weather, flooding, or events beyond the
Company’s control.
